Regulations of the SaintBy.pl Online Store

  1. Definitions

The terms used in the Regulations shall mean:

  1. Customer – a natural person, a legal person or an organisational unit that is not a legal person, to whom special provisions grant legal capacity and who places Orders in the Store;
  2. Consumer – a Customer who is a natural person and meets the criteria set out in the definition in Art. 22[1] of the Civil Code. According to this definition, a Consumer is a natural person who makes with an entrepreneur a legal transaction not related directly to his or her business or professional activity.
  3. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
  4. Regulations – these Regulations for the provision of electronic services as part of the saintby.pl online store;
  5. Online Store (Store) – the website available at https://saintby.pl, through which the Customer may in particular place Orders;
  6. Goods – products presented in the Online Store;
  7. Sales Agreement – an agreement for the sale of Goods within the meaning of the Civil Code, concluded between SaintBy Anna Baj, ul. ppłk. Zbigniewa Stanisława Kiedacza 24E, 02/776 Warsaw, NIP: 8212086387 and the Customer, concluded using the Store’s website;
  8. Consumer Protection Act – Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item. 827);
  9. Act on Providing Services by Electronic Means – act of 18 July 2002 on provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
  10. Order – declaration of intent of the Customer, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and amount of Goods.
  11. General Provisions
    1. These Regulations set out the rules for using the online store available at: https://saintby.pl and constitute the regulations referred to in Art. 8 of the Act on the provision of services by electronic means.
    2. The online store, operating at: https://saintby.pl, is run by SaintBy Anna Baj, ul. ppłk. Zbigniewa Stanisława Kiedacza 24E, 02/776 Warsaw, NIP: 8212086387.
    3. These Regulations specify in particular:
      1. rules for registering and using an account in the online store;
      2. terms and conditions for placing Orders by electronic means in the online store;
    4. Using the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
      1. Internet browser: IE version 7 or newer, FireFox version 3 or newer, Opera version 9 or newer, Chrome version 79 or newer, Safari, with the latest JAVA and FLASH versions installed, on screens with horizontal resolution above 1024 px. The use of third-party software affecting the functioning and functionality of the browsers: Internet Explorer, FireFox, Opera, Chrome and Safari may affect the correct display of the store, therefore, in order to obtain full functionality of the saintby.pl store, all such software should be disabled.
    5. In accordance with applicable law, SaintBy Anna Baj reserves the right to limit the provision of services via the Online Store to persons under the age of 18. In such an event, potential Customers shall be notified of the above.
    6. Customers can access these Regulations at any time via the link on the main page of the saintby.pl website and save its content and print it out.
  12. Rules of using the Online Store
    1. In order to ensure the security of transmission of messages and data in connection with the services provided on the Website, the Online Store shall undertake technical and organisational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent unauthorised collection and modification of personal data sent via the Internet.
    2. The Customer is obliged:
      1. not to provide and transfer any content prohibited by law, for example: violent, defamatory content or content violating personal rights and other rights of third parties,
      2. to use the online store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
      3. to use the online store in accordance with provisions of law applicable in the Republic of Poland, provisions of the Regulations as well as with the general principles of using the Internet.
  1. Procedure for the conclusion of a Sales Agreement
    1. Information about the Goods listed on the Store’s websites, in particular, their descriptions, technical and performance specifications as well as prices, constitute an invitation to enter into an agreement, within the meaning of Art. 71 of the Civil Code.
    2. In order to conclude a Sales Agreement via the Online Store, go to the website https://saintby.pl, select the goods and its colour from the Store’s offer, taking subsequent technical steps based on the messages displayed as well as the information available on the website.
    3. The selection of Goods ordered by the Customer is made by adding them to the shopping cart.
    4. When placing the Order – until you click on the button: “Order under payment obligation” or other equivalent button indicating the obligation to pay, e.g. “Order and pay,” the customer can modify the entered data and the selected Good. In order to do this, follow the messages displayed as well as information available on the website.
    5. After the Customer using the online store provides all the necessary data, a summary of the placed order will be displayed. The summary of the order shall contain the following information:
      1. subject of the order,
      2. unit and total price of ordered products or services, including delivery costs and additional costs (if any),
      3. chosen payment method,
      4. chosen delivery method,
      5. delivery time,
    6. In order to send an Order, it is necessary to provide personal data marked as mandatory and to press the button: “Order under payment obligation” or other equivalent button indicating the obligation to pay, e.g. “Order and pay.”
    7. Sending the Order by the Customer is a declaration of intent to conclude a Sales Agreement with SaintBy Anna Baj, in accordance with the Regulations.
    8. After placing the Order, the Customer receives an e-mail with the subject: “SaintBy.pl – You placed order No.”, containing the final confirmation of all essential elements of the Order.
    9. The Agreement shall be deemed concluded at the time the Customer receives the e-mail referred to above.
    10. The Agreement is concluded in Polish. Recording, securing and sharing the Order information as well as the general terms (Regulations of the Online Store) shall be carried out via e-mail.
  2. Delivery
    1. Delivery of the Goods is limited to Poland and the Goods shall be delivered to the address indicated by the Customer while placing the Order.
    2. The ordered Goods are delivered by courier: DPD, InPost Kurier and InPost Paczkomaty pickup station service. Delivery costs range from PLN 10.50 to PLN 72 depending on the chosen method of delivery and payment (prepayment or cash on delivery). The delivery costs will also be indicated at the time of placing the Order.
    3. The time of delivery is from 1 to 5 business days from the date of sending the Order by the Customer.
  3. Prices and Payment Methods
    1. The prices of Goods are given in Euro and cover all components, including VAT.
    2. The Customer has the option to pay the price by means of:
      1. bank transfer to the bank account number 68 1050 1054 1000 0091 3845 7180,
      2. Visa, Mastercard.
  4. Right to Withdraw from the Agreement
    1. The Customer who is a Consumer is entitled to a 14-day withdrawal period. The Consumer has the right to withdraw from this Agreement within 14 days without stating reasons. The deadline for the withdrawal from the Agreement expires 14 days from the date you came into possession of the goods or a third party other than the carrier and indicated by you came into possession of the goods.
    2. To exercise the right to withdraw, you must inform us SaintBy Anna Baj, ul. ppłk. Zbigniewa Stanisława Kiedacza 24E, 02/776 Warsaw, phone 733 160 400 e-mail: [email protected] about your decision to withdraw from this Agreement through a clearly worded statement (for example, a letter sent by post, fax or e-mail).
    3. You may use the attached withdrawal form, but it is not obligatory. You may also fill out and send the withdrawal form or any other clearly worded statement electronically on our website https://saintby.pl. If you use this option, we will immediately send you a confirmation of receipt of the information about the withdrawal on a durable medium (e.g. by email).
    4. In order to meet the deadline for withdrawal from the Agreement, it suffices to send us information about your intention to exercise the right to withdraw from the Agreement before the deadline for withdrawal expires.
  5. Consequences of Withdrawal from the Agreement
    1. In the event of withdrawal from this Agreement, we shall return all payments received from you, including the costs of delivery of the goods (with the exception of additional costs resulting from the delivery other than the least expensive standard delivery offered by us), immediately and in any event no later than 14 days from the date on which we have been informed about your decision to exercise the right of withdrawal from this Agreement. The reimbursement of the payment shall be made by means of the same payment methods that you have used for the original transaction, unless you have expressly agreed otherwise; regardless, you shall not incur any fees in connection with the reimbursement.

We reserve the right to withhold the reimbursement of the payment until we receive the goods or until you provide us with proof of its return, whichever is the earliest.

Please send or hand over the goods to the following address: ul. Siedlecka 159 Pruszyn Pieńki, 08-110 Siedlce, immediately, and in any case not later than 14 days from the day on which you informed us about withdrawal from this Agreement. The deadline is met if you send back the goods within 14 days. You will have to bear the direct cost of returning the goods. These costs are estimated at a maximum of approximately PLN 20. You shall be held responsible only if the goods depreciate in value as a result of their handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

  1. Complaints Concerning the Goods
    1. SaintBy Anna Baj as a seller is liable to the Customer who is a Consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in Art. 556 and Art. 556[1] -556[3] and subsequent articles of the Civil Code.
    2. Complaints arising from a breach of rights guaranteed by law or pursuant to these Regulations should be sent to [email protected]. The Seller undertakes to consider each complaint within 14 days.
  2. Complaints Regarding the Provision of Services via Electronic Means
    1. The online store shall take steps to ensure that the website and online store pages operate properly, to the extent resulting from its current technical knowledge, and undertakes to remove any technical irregularities reported by Customers within a reasonable time period.
    2. The Customer may report any irregularities related to the functioning of the website and online store pages in writing to the following address: SaintBy Anna Baj, ul. ppłk. Zbigniewa Stanisława Kiedacza 24E, 02/776 Warsaw, by email to [email protected].
    3. The Customer should describe in the complaint the type and date of occurrence of an irregularity related to the functioning of the Store.
  3. Dispute Resolution and Final Provisions
    1. A Customer who is a Consumer may, if interested, use out-of-court means for handling complaints and pursuing claims. Disputes regarding online purchases can be solved through mediation proceedings before Provincial Inspectorates of Trade Inspection or before the arbitration court at the Provincial Inspectorate of Trade Inspection. The Consumer may also use other methods of out-of-court dispute resolution and, for example, file a complaint through the EU ODR platform, available at: http://ec.europa.eu/consumers/odr/
    2. Matters not covered by these Regulations shall be governed by the Civil Code, the provisions of the Act on provision of services by electronic means and other applicable provisions of Polish law.
